The correct answer is that, when a defendant is found not guilty of the accused crime, the government cannot appeal.

There are always innocent persons that are involved in cases, in which they did not participate nor did they get involved in anything, which is why court hearings are made, so that innocent people may be free of their charges from their accusers.
